Please read these terms carefully before using EchoRoam eSIM services.

1. Introduction & Acceptance

Welcome to EchoRoam. These Terms of Service ("Terms") govern your access to and use of the EchoRoam website, mobile applications, and all related services (collectively, the "Services") operated by ZKZK PTY LTD, trading as "EchoRoam" ("we," "us," or "our"), a company registered in Australia (ABN 16 619 107 596). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree with any part of these Terms, you must not use our Services. We recommend that you print or save a copy of these Terms for your records. Your continued use of the Services following any changes to these Terms constitutes acceptance of those changes. These Terms apply to all users, including travellers, business professionals, and any other individuals or entities purchasing or using EchoRoam eSIM data plans.

EchoRoam provides digital SIM (eSIM) connectivity solutions designed for international travellers seeking reliable mobile data access across multiple countries and regions. Our platform connects you with leading local network operators worldwide, delivering seamless internet access without the need for physical SIM cards.

2. About EchoRoam Services

EchoRoam is a travel eSIM provider offering prepaid mobile data plans that work across 190+ countries and territories. Our Services allow you to purchase, download, and activate digital SIM profiles directly on your eSIM-compatible device, giving you instant access to mobile data networks without swapping physical SIM cards or dealing with expensive roaming charges from your home carrier.

Our eSIM data plans are delivered electronically via a QR code sent to your email address upon purchase. Each plan includes a specified data allowance (e.g., 1 GB, 5 GB, 10 GB, or unlimited data), a validity period (ranging from 7 days to 365 days), and coverage across designated countries or regions. Plans may support 5G, 4G/LTE, and 3G network speeds depending on the local network infrastructure available at your travel destination.

Coverage areas and available networks vary by plan. We work with multiple local mobile network operators in each country to provide you with the best possible coverage and speed. However, actual speeds, availability, and network quality depend on factors beyond our control, including local network congestion, geographic conditions, and your device capabilities. We publish coverage maps and supported networks on our website and within our app for transparency, and we recommend reviewing these before purchasing a plan for a specific destination.

3. Account Registration

To purchase and manage EchoRoam eSIM plans, you may be required to create an account. When registering, you must provide accurate, current, and complete information, including your full name, email address, and any other details we reasonably request. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify EchoRoam immediately of any unauthorised use of your account or any other breach of security. We reserve the right to suspend or terminate your account if any information provided during registration is found to be inaccurate, incomplete, or in violation of these Terms. Accounts registered by automated means or under false pretences may be cancelled without notice, and any associated purchases may be refunded at our discretion.

You must be at least 18 years of age to create an account and purchase EchoRoam services. By creating an account, you represent and warrant that you are of legal age to enter into a binding agreement and that all information you provide is truthful and accurate. If you are using our Services on behalf of a business or organisation, you further represent that you have the authority to bind that entity to these Terms.

4. Purchasing eSIM Plans

All EchoRoam eSIM plans are displayed on our website and mobile applications with clear pricing in Australian Dollars (AUD) or your selected local currency. Prices are inclusive of applicable taxes unless otherwise stated. The total price you pay at checkout includes the cost of the eSIM data plan and any applicable taxes or fees. We accept major payment methods including credit cards (Visa, Mastercard, American Express), debit cards, Apple Pay, Google Pay, and other payment methods as advertised on our platform.

By completing a purchase, you authorise EchoRoam to charge the selected payment method for the full amount of your order. All transactions are processed securely through our PCI-DSS compliant payment partners. We do not store your full credit card details on our servers. Prices are subject to change without notice, but any price changes will not affect orders that have already been confirmed and paid for.

EchoRoam may offer promotional pricing, discount codes, or bundle deals from time to time. Such promotions are subject to specific terms and conditions, including expiry dates and usage limits. We reserve the right to modify or cancel promotions at any time. Taxes may vary depending on your country of residence or the country associated with your payment method, and any additional tax obligations are your responsibility.

5. eSIM Activation & Usage

Upon purchasing an EchoRoam eSIM plan, you will receive a QR code and activation instructions via email. To activate your eSIM, you must scan the QR code using your eSIM-compatible device and follow the on-screen instructions to install the eSIM profile. Activation typically begins when you connect to a supported network at your travel destination, or immediately upon installation depending on the plan type.

Each eSIM plan has a defined validity period, which starts from the moment of activation (not from the date of purchase). The validity countdown begins when the eSIM first connects to a partner network, regardless of whether data is actively used. Once the validity period expires, the eSIM profile becomes inactive and any remaining unused data allowance is forfeited. We recommend activating your eSIM only when you are ready to begin using data at your destination.

EchoRoam operates a fair use policy to ensure the best possible experience for all users. While we offer generous data allowances, activities that unreasonably consume network resources—such as continuous high-bandwidth streaming, operating as a permanent hotspot replacement for multiple devices, or running automated data processes—may result in speed management or service restrictions. Our fair use thresholds are designed to be generous for typical travel use, including browsing, navigation, messaging, and moderate streaming.

6. Data Allowances & Speeds

Each EchoRoam plan includes a specific high-speed data allowance. Once you exceed this high-speed allowance, your data speed may be reduced (throttled) for the remainder of the plan's validity period. Reduced speeds are typically sufficient for messaging, email, and light browsing, but may not support high-bandwidth activities like video streaming or large file downloads. Some plans may be advertised as "unlimited," in which case high-speed data is provided up to a stated threshold, after which standard-speed data continues without additional charges.

Actual data speeds depend on the local network operator and the technology available at your location (5G, 4G/LTE, or 3G). We partner with leading network operators in each country to deliver the fastest available speeds, but we cannot guarantee specific speeds at any given time or location. Factors such as network congestion, building structures, weather conditions, and device capabilities all affect the speeds you experience.

Tethering and personal hotspot usage are permitted on most EchoRoam plans unless otherwise specified. However, tethered usage counts towards your total data allowance, and excessive tethering may trigger our fair use policy. Plans that explicitly include hotspot allowances will have the permitted number of tethered devices stated in the plan details. Using your eSIM in devices other than the one it was originally installed on may not be supported, as eSIM profiles are generally locked to the device of installation for security reasons.

7. Refund Policy

Our refund policy is designed to be fair and transparent. In summary, we offer refunds for plans that have not been activated and were purchased within the last 7 days, as well as full refunds or replacements for plans that fail to work due to technical issues on our end.

Refund requests for activated plans, expired plans, or plans that have been partially used are generally not eligible for a refund. However, we review all requests on a case-by-case basis and may offer partial refunds or account credit in exceptional circumstances. Contact our support team if you believe your situation warrants special consideration.

8. Prohibited Uses

You agree not to use EchoRoam services for any unlawful, harmful, or abusive purpose. Specifically, you must not use our services to transmit, store, or access any content that is illegal, defamatory, harassing, threatening, or otherwise objectionable. This includes but is not limited to content that infringes on intellectual property rights, promotes violence, or violates any applicable local or international law.

You must not resell, redistribute, or sublicense EchoRoam eSIM plans to third parties without our express written consent. Our services are intended for personal and business travel use by the account holder. Wholesale distribution, reselling at markup, or bundling our plans with third-party products requires a separate commercial agreement with EchoRoam.

Additionally, you must not use EchoRoam services to operate automated systems, run continuous data-heavy applications (such as crypto mining, server hosting, or surveillance systems), or engage in any activity that degrades network performance for other users. We reserve the right to suspend or terminate service, without refund, for accounts found to be in violation of these prohibited uses.

9. Limitation of Liability

To the maximum extent permitted by Australian law, EchoRoam Global Ltd., its directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services. This includes, but is not limited to, damages for loss of profits, data loss, business interruption, personal injury, or any other commercial losses, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising from or related to these Terms or our Services shall not exceed the total amount you paid to EchoRoam in the twelve (12) months preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or any other theory.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable Australian consumer law. Where legislation implies warranties or conditions that cannot be excluded, our liability is limited to the fullest extent permitted by law, including at our option, replacing or repairing goods or resupplying services.

10. Service Availability

EchoRoam strives to provide reliable, uninterrupted access to mobile data services across all covered destinations. However, we do not guarantee 100% coverage or service availability at any specific location or time. Mobile network coverage depends on the infrastructure and capabilities of our partner network operators, which may be affected by factors beyond our or their reasonable control.

Service interruptions may occur due to network maintenance, natural disasters, government restrictions, power outages, or other force majeure events. We are not responsible for any loss, damage, or inconvenience caused by such interruptions. In the event of a prolonged or widespread outage affecting a particular region, we will make reasonable efforts to notify affected customers and may offer extensions or credits at our discretion.

Coverage maps and network information published on our website are provided as general guidance only and do not constitute a guarantee of service availability at any specific address or location. We recommend checking coverage for your specific destinations before travel and ensuring your device is compatible with the local network frequencies.

11. Changes to Terms

EchoRoam reserves the right to update, modify, or replace these Terms at any time at our sole discretion. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, for significant changes, by sending a notification to the email address associated with your account or displaying a prominent notice on our website and app.

Changes to these Terms will become effective immediately upon posting the revised version unless we specify a different effective date. Your continued use of our Services after any changes take effect constitutes your acceptance of the revised Terms. If you disagree with any changes, you must stop using our Services immediately and may request account deletion by contacting our support team. We encourage you to review these Terms periodically to stay informed of any updates.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia, specifically the laws of the State of New South Wales. Any disputes arising out of or in connection with these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

EchoRoam operates globally and provides services to customers worldwide. However, these Terms and any disputes arising under them are governed by Australian law regardless of your location. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The failure of EchoRoam to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
